Privacy Policy: HOCH-Husten / DIGI-PREDICT

This Privacy Policy ("Policy") describes how Resmonics AG ("Company," "we," "us," or "our") collects, uses, and protects the personal information and data collected from users ("User," "you," or "your") of the HOCH-Husten / DIGI-PREDICT Cough detection mobile application ("App") and its associated services ("Services"). By accessing or using the App or Services, you agree to the terms and conditions set forth in this Policy.

Information We Collect

1.1. Personal Information: When you use the App and Services, we may collect certain pseudonymized information, such as your study ID, study email address, and other identifiable information that you voluntarily provide to us as a participant in the research study conducted by the University of Auckland or the Cantonal Hospital of St. Gallen. ​

 

1.2. Audio Recordings: The App collects short segments (approximately 650ms) of audio recordings. These recordings are triggered when the App detects sounds that it determines to be respiratory symptoms, such as coughing. This determination is made by a proprietary acoustic artificial intelligence, parts of which are a CE-certified software as a medical device in Europe.

 

1.3. App Usage Data: The App collects usage data, including but not limited to measurement results about a person's cough and details about recorded monitoring sessions (e.g., start/end of session, number of coughs, timestamps, time zones, cough assessments generated by our artificial intelligence, and errors occurred during monitoring).

Use of Collected Information

2.1. Personal Information: We may use your personal information for the following purposes:

2.1.1. To provide and improve the App and Services;

2.1.2. To communicate with you and respond to your inquiries;

2.1.3. To send you important notices and updates regarding the App and Services;

2.1.4. To personalize your experience and provide tailored insights;

2.1.5. To analyze usage patterns and conduct research and development activities;

2.1.6. To enforce this Policy and our Terms and Conditions;

2.1.7. To comply with legal obligations.

2.2. Audio Recordings: The audio recordings are used for analyzing respiratory symptoms, identifying potential health conditions, improving existing algorithms, and developing novel algorithms. These recordings are processed using automated algorithms to provide research insights. All audio recordings are pseudonymized to ensure privacy. Resmonics AG primarily accesses de-identified and coded data.

 

2.3. App Usage Data: Usage data is used for analyzing respiratory symptoms and refining our artificial intelligence. This data is pseudonymized to ensure individual privacy and confidentiality in accordance with Swiss and New Zealand research standards.

Data Sharing and Disclosure

3.1. We may share your personal information and audio recordings with third parties under the following circumstances:

3.1.1. With your explicit consent;

3.1.2. To comply with legal obligations, such as responding to lawful requests from government authorities in Switzerland or New Zealand;

3.1.3. To enforce our rights or defend against legal claims;

3.1.4. In connection with a corporate transaction (e.g., merger or acquisition), where data may be transferred as a business asset.

 

3.2. We may also share anonymized data, including audio data, with third parties for commercial purposes, research and development, statistical analysis, or other lawful purposes.

Data Security

4.1. We implement reasonable security measures to protect your personal information and audio recordings from unauthorized access, disclosure, or alteration. Data is encrypted during transit and at rest. However, no method of electronic storage is 100% secure, and we cannot guarantee absolute security.

Third-Party Links and Services

5.1. The App and Services utilize third-party infrastructure; for example, data is uploaded to secure servers hosted by Amazon Web Services (AWS). This Policy does not apply to third-party platforms, and we are not responsible for their independent privacy practices.

Children's Privacy

6.1. If we become aware that we have collected personal information from a child under 13 (or 16, depending on local jurisdiction) without parental consent, we will take steps to delete the information immediately. If you believe such data has been collected, please contact us.

Data Retention

7.1. We retain your personal information and audio recordings for as long as necessary to fulfill the research and development purposes outlined in this Policy, or as required by the specific data retention protocols of the University of Auckland or the Cantonal Hospital of St. Gallen.

Your Rights and Choices

8.1. You have certain rights regarding your personal information under the Swiss FADP and the New Zealand Privacy Act, including the right to:

8.1.1. Access and obtain a copy of your personal information;

8.1.2. Correct or update your personal information;

8.1.3. Delete your personal information;

8.1.4. Object to or restrict the processing of your data;

8.1.5. Withdraw your consent at any time;

8.1.6. Lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) or the New Zealand Privacy Commissioner. ​
